1. Acceptance of Terms

By accessing or using LaunchMap AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you also agree to our Privacy Policy.

2. Description of Service

LaunchMap AI is an AI-powered content planning and generation platform that provides:

  • AI-generated content calendars for social media
  • Personalized post creation using artificial intelligence
  • AI image generation for social media content
  • Content scheduling and planning tools
  • Social media publishing integration (optional)
  • AI chat assistant for content-related queries

The Service uses third-party AI providers (Anthropic Claude, Ideogram) to generate content and images. Output quality depends on these providers and the information you provide.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Service.

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer the following subscription plans:

  • Trial: Limited features and usage for evaluation purposes
  • Boost: Standard features with monthly AI content and image limits
  • Ignite: Premium features with higher AI content and image limits

4.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • Prices may change with 30 days' notice
  • Payment is processed securely through Stripe

4.3 Usage Limits

Each subscription tier includes monthly limits on:

  • Number of AI-generated images
  • Number of content calendars
  • AI chat messages

Limits reset monthly. Unused quota does not roll over to the next month.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access until the end of your current billing period. After that, your account will be downgraded and you will lose access to premium features.

5. User Responsibilities

You are responsible for:

  • All content you create, generate, or publish using the Service
  • Reviewing and editing AI-generated content before publishing
  • Ensuring your content complies with applicable laws and platform terms
  • Obtaining necessary rights for any content you upload (images, text)
  • Your use of social media integrations and publishing features

We do not review content before it is published to your social media accounts. You bear full responsibility for published content.

6. AI-Generated Content

6.1 Nature of AI Content

Content generated by our AI:

  • Is provided as suggestions and starting points only
  • Should be reviewed and edited before use
  • May contain errors, inaccuracies, or inappropriate content
  • May not be unique (similar content could be generated for other users)
  • Should not be relied upon as professional advice

6.2 AI Limitations

AI-generated content:

  • May not reflect current events or real-time information
  • May produce factually incorrect statements
  • Quality depends on the information you provide
  • Is subject to AI provider availability and performance

6.3 Content Ownership

You retain ownership of content you create using the Service. However, you grant us a license to use your content as necessary to provide the Service. AI-generated text and images may be used by you for any lawful purpose, subject to any restrictions from our AI providers.

7. Prohibited Uses

You agree not to use the Service to:

  • Generate illegal, harmful, threatening, abusive, or defamatory content
  • Create content that infringes intellectual property rights
  • Generate spam, misleading, or deceptive content
  • Create content depicting minors in inappropriate contexts
  • Generate hate speech or discriminatory content
  • Create content promoting violence or illegal activities
  • Attempt to circumvent usage limits or security measures
  • Use automated tools to access the Service without permission
  • Reverse engineer or attempt to extract AI models or algorithms
  • Resell or redistribute the Service without authorization
  • Impersonate others or create misleading personas

We reserve the right to suspend or terminate accounts that violate these prohibitions.

8. Intellectual Property

8.1 Our Property

The Service, including its original content (excluding user-generated content), features, and functionality, is owned by LaunchMap AI and protected by copyright, trademark, and other laws.

8.2 Your Content

You retain all rights to content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process that content solely to provide the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

9. Third-Party Services

The Service integrates with third-party services including:

  • Anthropic (Claude AI) - content generation
  • Ideogram - image generation
  • Stripe - payment processing
  • Social media platforms (when you connect accounts)

Use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or content of third-party services.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Third-party service outages
  • Circumstances beyond our control

We will make reasonable efforts to notify users of planned maintenance.

11. Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Violation of prohibited uses
  • Request by law enforcement or government agencies
  • Suspected fraudulent or illegal activity
  • Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. You may request a copy of your data before termination takes effect.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be error-free or uninterrupted
  • Warranties regarding the accuracy of AI-generated content
  • Warranties that the Service will meet your specific requirements
  • Warranties regarding results from using the Service

AI-generated content should not be relied upon as professional, legal, financial, or medical advice. Always review content before publishing or acting on it.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LAUNCHMAP AI BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Business interruption
  • Any damages arising from AI-generated content
  • Any damages from third-party services or integrations

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless LaunchMap AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LaunchMap AI regarding the Service and supersede any prior agreements.
